Welcome to By Your Side Solutions LLC, doing business as Rondout Environmental, a New York limited liability company ("Rondout Environmental," "Company," "we," "us," or "our"). By using this website, our services, or opting in to receive communications, you agree to these Terms and Conditions.
1. About these terms
These terms govern your use of this website and your consent to communications. They do not govern inspection, assessment, or reporting work. That work is covered by a separate written agreement for each inspection.
2. Our services
Rondout Environmental provides asbestos inspection, lead paint inspection, water damage inspection, and mold assessment and inspection for properties in the Hudson Valley, the Catskills, and beyond, from Kingston, New York. We inspect and assess. We don't do remediation or abatement, and we don't provide engineering services.
By engaging with our services, you agree to provide accurate information and to use our services for lawful purposes.
3. Communication consent (calls, SMS, and email)
By submitting your information through our website, forms, or other channels, you consent to receive phone calls and email from Rondout Environmental about your request and your inspection. These communications may be used for appointment scheduling and reminders, inspection and report updates, quotes, billing notifications, follow-ups, and customer support.
Text messages are separate, and they are optional. Our form offers one text message consent, with its own unticked box: texts about your inquiry and appointment scheduling. We do not send marketing texts. The box is not required to submit the form, to receive a reply, or to buy anything from us, and submitting the form is not by itself consent to be texted.
SMS consent and A2P compliance. Message frequency varies depending on your interaction with us. Message and data rates may apply. You can opt out at any time by replying STOP to any message. Reply HELP for assistance or contact us directly. We do not send unsolicited messages, and we text only people who have given consent for that kind of message.
We do not share your SMS consent or your phone number with third parties for their own marketing.
How to opt in. Tick the text message box on a form on this website, or tell us during a phone or in-person conversation that we may text you. A box is never ticked for you.
How to opt out. Reply STOP to any text message to unsubscribe. After opting out you will no longer receive text messages from us unless you opt in again.
4. Carrier Liability
Carriers are not liable for delayed or undelivered messages.
5. Age Restriction
You must be 18 years of age or older to use this SMS service.
6. Use of this website
You may use this website for lawful purposes only. You may not scrape or harvest content, interfere with the operation of the site, attempt unauthorized access to any part of it, or use it in any way that could damage or impair it.
7. Intellectual property
All content on this website, including text, photography, graphics, logos, and marks, belongs to Rondout Environmental or its licensors and may not be copied, reproduced, or used without our written permission.
8. Photography and imagery
Images on this site illustrate the kind of work we do. They are not findings for any property, they are not a representation that any inspection will find the same conditions, and they are not part of any agreement.
9. Pricing information
Prices shown by the instant quote tool on this website are estimates for general guidance only. They are not quotes or offers. The price for your inspection depends on the property and the agreed scope, and is confirmed in a written agreement before any work begins. Prices are subject to change.
10. Service terms
Every inspection is subject to a separate written agreement that sets out its scope and fee. We confirm any change or additional charge before doing extra work.
Payment. Payment is due before the report is released. A late fee of 2% per month applies after 15 days.
Cancellations and rescheduling. Cancellations within 24 hours of the appointment incur a $75 rescheduling fee.
11. No professional advice
Content on this website is general information. It is not an inspection, an assessment, or a report for any property, and it is not engineering, legal, or medical advice. It should not be relied on as such.
12. Third-party links
Our site links to third-party websites, including the government and standards sources it cites. We do not control those sites and are not responsible for their content or practices.

15. Limitation of liability
To the fullest extent the law allows, Rondout Environmental is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising out of your use of this website, whether the claim is framed as breach of contract, negligence, or anything else, and even if we were told such damages were possible.
Where liability cannot be excluded, our total liability for any claim arising out of this website is limited to one hundred dollars.
Nothing here excludes liability that cannot be excluded by law, including for fraud or for death or personal injury caused by negligence. As with the section above, this is about the website; liability for inspection work is governed by the written agreement for that inspection.
16. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of these terms or your use of this website will be brought exclusively in the state or federal courts located in Ulster County, New York, and you consent to the jurisdiction and venue of those courts.
17. Changes to these terms
We may update these Terms and Conditions at any time. Updates are posted on this page with a revised effective date.
